2. Description of Service

MBI is an AI-powered construction budget estimation platform designed for contractors, estimators, and construction professionals. The platform uses artificial intelligence to analyze construction plans and generate forensic budget estimates across architectural, structural, mechanical, electrical, and plumbing divisions.

3. AI-Generated Estimates Disclaimer

IMPORTANT: All estimates, reports, and quantities produced by MBI are AI-generated outputs intended for preliminary budgeting and planning purposes only. MBI outputs:

• Are NOT licensed engineering, architectural, or construction documents
• Are NOT suitable for permit submission, formal bidding, or construction without independent verification by a licensed professional
• Are valid for 30 days from date of issue — material and labor costs change over time
• May contain errors or omissions — always verify quantities against actual plans

Makai US Group LLC is not a licensed contractor, engineer, or architect. Use of MBI outputs for construction decisions is entirely at the user's own risk.

4. Subscription & Billing

• Plans: MBI is offered on subscription tiers ranging from $99/month to $299/month depending on features and usage volume.
• Free Trial: New accounts may include a limited trial period as specified at signup.
• Billing: All payments processed by Stripe. Makai US Group LLC does not store credit card data.
• Renewal: Subscriptions renew automatically on the same date each billing cycle.
• Cancellation: Cancel anytime from your account settings. Access continues until the end of the current billing period. No partial refunds.
• Price Changes: We reserve the right to change pricing with 30 days advance email notice.

5. Permitted Use

MBI is licensed for use by the registered account holder and their authorized team members within a single business entity. You may not resell MBI outputs as a standalone service, sublicense platform access, or use MBI to build a competing estimation product.

6. Prohibited Use

• Submitting MBI estimates as certified professional documents without independent licensed review
• Reverse-engineering, scraping, or extracting AI logic, prompts, or pricing data
• Uploading confidential client plans without authorization from the plan owner
• Sharing account credentials or enabling unauthorized third-party access
• Using MBI outputs to misrepresent project costs to clients, lenders, or government agencies

7. Uploaded Plan Data

Construction plans and documents you upload to MBI for analysis are processed by AI and are not permanently stored on our servers after the analysis session. We do not share, sell, or use your uploaded plans for any purpose other than generating your requested estimate. You represent that you have the right to upload any plans submitted to MBI.

8. Intellectual Property

All MBI software, AI logic, pricing databases, UI design, and branding are the exclusive intellectual property of Makai US Group LLC. Your uploaded plans and generated estimate reports belong to you. We claim no ownership over your project data or reports.

9. Service Availability

We aim for continuous uptime but do not guarantee uninterrupted service. AI processing depends on third-party API availability (Anthropic Claude). Downtime does not entitle users to refunds unless service is unavailable for more than 72 consecutive hours in a billing period.

10. Limitation of Liability

To the maximum extent permitted by law, Makai US Group LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages — including financial losses, project cost overruns, or bid errors — arising from use of MBI outputs. The user assumes full responsibility for all construction and business decisions.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to maintain an active subscription. You may close your account at any time from your account settings.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Disputes shall be resolved in Harris County, Texas courts.

13. Changes to Terms

We may update these Terms at any time. Continued use of MBI after updates constitutes acceptance. Material changes will be communicated by email to active subscribers.
